Divorce and Separation Agreements

It is estimated that almost half of all marriages in England and Wales will end in divorce if current trends continue (The Office for National Statistics, 27th March 2008).

Divorce can affect anyone; irrespective of race, age or class. It is a sad fact of life that relationships break down, and here at Kale and Co we aim to make the process of separating and divorcing as painless as possible.

There are a number of options available to separating couples including Judicial Separation, Nullity and Deeds of Separation; we will advise you on the most relevant option to suit your particular case.

Divorce is another such option. There is only one ground for divorce, namely that the marriage has irretrievably broken down. To satisfy the court that this is the case, your petition for divorce will have to be based on one of five facts:

  • Adultery
  • Unreasonable Behaviour
  • Desertion
  • Two Years Separation (where your Spouse consents to a divorce being granted)
  • Five Years Separation
